Notice Period

I have joined a company on 2008 as labor (no offer letter given) and contract which i signed is unlimited. later on i get promoted during my employment now i got a better offer and i resigned from my current job in which my boss instructed me that i have to serve a 90 days notice period instead of 30 days. in my resignation i stated a family problem. please advice is there any rule for a notice period of 90 days if not agreed or signed mutually. awaiting your earliest response.
