gratuity(pension) problem

sir, i worked for a company about 10 years and they terminated me from the job now company is giving me only 5 years gratuity(pension) and one month notice period salary they took our signature in 2008 on a paper where i agree that i got my gratuity before 2008 as per my knowledge the gratuity should be calculated on last salary so what should i do?? please advice. thank you
